Appeltt was charged with first -degree murder, entered a plea not guilty, trial by jury resulted in conviction of appellant of crime of second-degree murder, appellant sentenced to Indiana State Prison for life. Appellant claims that "Miranda" warninos were insufficient, making his signed confession inadmissible, and evidence insufficient to sustain a conviction for second-degree murder, due to the fact that he claimed to have been intoxicated at the time of the crime. The court found that the form followed by the Indianapolis Police Department is sufficient and the appellant was adequately informed of his rights; and also found that although appellant changed his story at the trial, he admitted having the intent and that he was not intoxicated at the time. He made statements at the scene, which he did not deny at the trial, indicating clearly he intended his actions. Judgment of the trial court affirmed.

Appelee Indiana Liquor Stores Association Incorporated brief, certificate of service filed. 871 A167 Moster vs. Bower, Administratrix of the Estate of This Alva case is Bower, an appeal Deceased. under Decatur Circuit law common negligence, the question being whether or not there was any evidence or a reasonable inference that decedent failed to exercise reasonable care for the safety of others. Appellantwa a clerk in a sporting goods store which was destroyed in an appellee decedent was killed in the blast and appellant criticay injured.

There was evidence that a man came into the store and asked the cerk about rifle scopes, then left and re-entered with a rifle that appeared to be a .22 caliber; apparently then, in some manner discharging a live round into a stack of primers. In addition to inferences drawn from the evidence, there was direct evidence that appellant, although critically injured, was able to stagger out of the building, and the decedent's body was found in the store building after the store had been completely destroyed by the explosion and fire. The court found that the evidence is not strong enough that it may be decided that the evidence presented at the trial supported, without conflict, only one inference, which inference was a favor of the appellee. In their opinion, reasonable men could come to that inference, but would not necessarily be forced to come to that inference only Cause reversed and remanded to trial court for new trial.
